2016 Regulations of Interest

 

December 14: The following Proposed Regulations have been issued by the Department of Health:

 

September 14: A Proposed Rule Making was issued by DOH related to the Medical Use of Marihuana.  The rule would authorize nurse practitioners to register with NYSDOH in order to issue certifications to patients with qualifying conditions for access to medical marihuana.

 

August 24:  A Proposed Rule Making was issued by OASAS to Repeal Obsolete Rules: General Provisions; Inpatient Programs; Funding for Services; Authorizing MDs; HIV-AIDS; Hearings.

 

July 27:  The following Notices of Adoption have been issued by the Office of Alcoholism and Substance Abuse Services:

 

May 4: A Proposed Rulemaking was issued by OMH on Incident Management.  The proposal serves to make regulatory updates that are necessary as a result of the passage of Chapter 501 of the Laws of 2012 (which created the Justice Center for the Protection of Persons with Special Needs), the promulgation of HIPAA in 2003, and to reflect the Office of Mental Health’s updated restraint and seclusion regulations in 14 NYCRR Part 526.

 

April 27:  Two notices have been issued by OMH related to the following:

 

February 24:  A Proposed Rule Making was issued by SOMH related to Rights of Patients.

 

January 27: Two Notices of Adoption have been issued by SED related to the following:

 

January 6:  A Notice of Adoption was published by OMH related to Visitation and Inspection of Facilities.
